  • client organisation representatives;
  • website visitors and people who contact us;
  • suppliers and professional contacts; and

Depending on how you interact with PLANERGY AI, we may collect information including:

  • name;
  • work email address;
  • job title and organisational role;
  • organisation name;
  • contact details;
  • purchaser and Authorising Contact details;
  • Client Lead details;
  • participant invitation and access information;
  • billing and transaction information;

  • communications with us;
  • acceptance and acknowledgement records;
  • system, security and audit records; and
  • other information reasonably necessary to provide, secure or administer the service.

We do not require PLANERGY AI to store complete payment-card details. Card payments are handled through the applicable payment provider.

4. Workforce and program information

The PLANERGY AI program collects information about work, workflows, AI use, organisational practices, capability, implementation and related matters.

Some information supplied by participants may constitute personal information because it relates to an identifiable individual.

PLANERGY AI is designed to use participant information to develop evidence about organisational AI adoption while limiting unnecessary exposure of confidential individual responses.

5. Sensitive information

PLANERGY AI is not designed to require participants to provide sensitive personal information unless there is a legitimate and lawful reason for doing so.

Participants and client organisations should avoid uploading unnecessary sensitive information, personal information about unrelated third parties, credentials, secrets or other information that is not reasonably required for the program.

If sensitive information is collected, we will handle it in accordance with applicable legal requirements.

6. How we collect information

We may collect personal information:

  • directly from you;
  • from the organisation purchasing or administering PLANERGY AI;
  • from an Authorising Contact or Client Lead;
  • when an organisation supplies participant details;
  • when you complete program activities;
  • when you upload a document or other material;
  • when you communicate with us;
  • through our website and systems;
  • through payment, accounting and communications processes; and
  • from service providers where necessary to operate or administer PLANERGY AI.

7. Information supplied by organisations

A client organisation may provide participant or Client Lead information so that PLANERGY AI can establish access and deliver the program.

Client organisations are responsible for ensuring that they have an appropriate basis to collect and provide that information to us.

Where another person nominates you as a Client Lead, we may record the identity of the person who made that nomination and tell you who nominated you.

8. Why we collect and use personal information

We may collect, hold, use and disclose personal information to:

  • provide PLANERGY AI;
  • process organisational purchases;
  • establish and administer client organisations and cohorts;
  • invite and authenticate Client Leads and participants;
  • deliver program activities;
  • maintain participant and program progress;
  • process and analyse program evidence;
  • generate organisational findings and reports;
  • support evidence-based implementation activity;
  • communicate about the purchased program;
  • provide support;
  • process payments and maintain accounting records;
  • maintain legal and contractual acceptance records;
  • prevent fraud, misuse and unauthorised access;
  • protect the security and integrity of our systems;
  • investigate and resolve problems;
  • maintain auditability;
  • comply with legal obligations;
  • establish, exercise or defend legal rights; and
  • improve and administer our service where permitted by law.

9. Participant confidentiality

PLANERGY AI distinguishes between confidential participant responses and information intended for management-facing organisational use.

Individual assessment and program responses are not intended to be displayed to client management as individual answers merely because the organisation purchased the program.

Management-facing views may include information such as participation and progress status, aggregated or organisational findings, evidence-supported opportunities, implementation information and other outputs permitted by the program's evidence and privacy controls.

Client organisations are not authorised to circumvent these controls to obtain confidential individual participant responses.

10. Pseudonymity

PLANERGY AI may process participant evidence using participant identifiers rather than displaying participant names throughout the evidence system.

This reduces unnecessary exposure of identity but does not make the information completely anonymous.

Under controlled circumstances, PLANERGY AI may retain the ability to associate a participant identifier with the relevant participant record for legitimate purposes including access administration, security, auditability, correction, support and legal compliance.

11. AI-assisted processing

Artificial intelligence and automated systems are used as components of PLANERGY AI.

Information supplied through the program may be processed using AI-enabled services to support functions such as analysis, classification, synthesis, program delivery and preparation of organisational outputs.

We apply access, evidence and human-judgement controls to the use of AI within the program.

We do not treat AI output as inherently infallible.

12. Uploaded documents

Client Leads or participants may be invited to upload supporting documents where relevant to the program.

Uploaded documents may contain personal, confidential or organisational information.

Only information reasonably relevant to the requested purpose should be uploaded.

We may process uploaded material to provide the program, generate evidence or outputs, maintain auditability, provide support, or meet legal and security requirements.

13. Purchases, Stripe and payment information

PLANERGY AI may use Stripe to process payments.

Payment information required to process the transaction is provided to the payment provider.

PLANERGY AI may retain transaction information such as the amount, currency, payment status, transaction reference and information needed to associate the payment with the relevant organisational order.

PLANERGY AI does not require or intend to store complete card numbers or card security codes.

14. Accounting and Xero

Planergy Productions Pty Ltd uses Xero for accounting and tax invoicing.

Information necessary for invoicing, payment reconciliation and accounting may be provided to Xero. This may include organisational identity, billing details, transaction information and relevant contact details.

PLANERGY AI may retain Xero invoice and payment identifiers to maintain the commercial and audit record associated with an order.

15. Communications

We use electronic communications to deliver transactional and program messages, including purchase, setup, activation, participation and program communications.

Information necessary to send and manage those communications may be processed by communications service providers used by PLANERGY AI.

We may retain delivery, status and related audit information where reasonably necessary to administer the service.

16. Service providers

We use third-party service providers to operate PLANERGY AI.

Depending on the function being performed, these may include providers of:

  • application and cloud infrastructure;
  • database and storage services;
  • artificial intelligence services;
  • payment processing;
  • accounting;
  • email and transactional communications;
  • security and monitoring; and
  • other technical or professional services required to operate the program.

We seek to limit the personal information made available to service providers to information reasonably required for the relevant service.

Service providers may change as our systems develop. This Privacy Policy will be updated where a change materially affects how personal information is handled.

17. Overseas processing and disclosure

Some technology and service providers used by PLANERGY AI may process, store or access information outside Australia.

Where personal information is disclosed to an overseas recipient and Australian Privacy Principle 8 applies, we will take reasonable steps required by applicable law in relation to that disclosure.

Personal information may be disclosed to, or processed by, service providers located outside Australia, including in the United States, New Zealand and other jurisdictions in which PLANERGY AI's technology providers and their subprocessors operate. This is not an exhaustive list of countries.

18. Direct marketing

We may use contact information to communicate about PLANERGY AI products or services where permitted by law.

Where required, marketing communications will provide a means to opt out.

Transactional or operational messages required to administer a purchased program are different from marketing communications and may continue where reasonably necessary to provide the service.

19. Security

We take reasonable technical and organisational measures designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Measures may include:

  • access controls;
  • authentication and secure access links;
  • separation between client organisations;
  • participant identifiers;
  • database and application security controls;
  • audit records;
  • restricted administrative access;
  • security testing and monitoring; and
  • operational controls designed to limit unnecessary exposure of information.

No online system can guarantee absolute security.

20. Data breaches

We maintain processes for identifying, assessing and responding to suspected data breaches.

Where the Notifiable Data Breaches scheme or another applicable law requires notification of an eligible data breach, we will take the steps required by that law.

21. Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it is held, including:

  • delivery and administration of the program;
  • maintenance of evidence and program records;
  • accounting and tax obligations;
  • contractual and acceptance records;
  • security and fraud prevention;
  • auditability;
  • dispute management; and
  • other legal or regulatory requirements.

Retention periods may differ according to the type and purpose of the information.

Where personal information is no longer required and we are not legally required or otherwise permitted to retain it, we will take reasonable steps to destroy or de-identify it.

22. Access to personal information

You may request access to personal information we hold about you.

We will respond in accordance with applicable law and may need to verify your identity before providing access.

There may be circumstances in which access is limited or refused as permitted by law. Where required, we will explain the basis for that decision.

23. Correction

If you believe personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it.

We will take reasonable steps to maintain the quality of personal information we use and disclose and will respond to correction requests in accordance with applicable law.

24. Participant requests

Participants may contact PLANERGY AI regarding personal information held about them.

Depending on the nature of the request and the relationship with the client organisation, we may need to coordinate with the organisation while preserving the confidentiality controls applying to participant responses.

A participant is not required to obtain management permission merely to raise a privacy enquiry or make a request directly to PLANERGY AI.

25. Privacy complaints

If you have a concern about how PLANERGY AI has handled your personal information, you may contact us using the privacy contact details published with this policy.

We will review the concern and respond within a reasonable period.

If you are not satisfied with our response and the Privacy Act applies, you may be entitled to complain to the Office of the Australian Information Commissioner.

26. Anonymity and pseudonymity

Where practicable and lawful, people may interact with us without identifying themselves or by using a pseudonym.

Identification is necessary for some PLANERGY AI functions, including organisational purchasing, secure program access, participant administration and maintaining appropriate evidence and audit records.

Within the program, participant identifiers may be used to reduce unnecessary exposure of participant identity.

27. Links and third-party services

PLANERGY AI may contain links to or interact with third-party services.

Third parties may have their own privacy policies and practices. Where you interact directly with a third-party service, its privacy terms may also apply.

28. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes to our services, technology, legal obligations or information-handling practices.

The current version and effective date will be published on the PLANERGY AI website.

Where appropriate, material changes affecting an active program may also be communicated directly.

Historical acceptance records will retain the version of the privacy policy acknowledged at the relevant event.
